A woman recognized as Fatima has called on Dutse Sharia court to dissolve her five-year-old marriage following her husband’s alleged inability to satisfy her sexually.
The 29-year-old woman stated that during their marriage, she at no point had a miscarriage not to talk of having a baby.
She stated that the lack of a child in their relation saw them quarrel at different times and her husband refused to seek medication for his problem.
The woman who stated that she needs a child requested the court to dissolve their marriage for her to remarry and give birth.
The husband, Malam Sa’idu Maiinji while speaking in the Sharia court, stated that his made up the accusation just to damage his image for her selfish reason.
He stated that he was examined at Sakwaya Hospital and was certified normal, and can have a child.
Sa’idu stated that his wife took it upon herself to take the action because he stopped her from visiting a neighbour who used to influence her.
He stated that this is not the first time that his wife will stay at her parents’ house for over seven months.
The husband revealed that he had been pleading with her to return to the house but she had refused to do so.
He called on the court to order her to pay him the #200, 000 he spent to marry her as well as the #20, 000 he paid for her dowry.
The Sharia court judge, Ibrahim Yusuf Harbo, in his ruling ordered the wife to pay her husband the sum of 20,000 she received as dowry.
Malam Sa’idu while speaking with newsmen stated that he is not satisfied with ruling of the court and he will appeal the judgment.
The Islamic law provided that when a woman requests divorce from her husband, such woman must give back to her husband the dowry that was paid to her upon marriage.
In the event that the husband refuses to accept this payment, a court of Islamic law has the power to dissolve the marriage regardless of whether the husband opposes it.
